Terms of Service

These Terms of Service ("Terms") govern your use of Kept Word. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The basics

Kept Word ("Kept Word," "we," "us") is a living memory service operated by Human Underneath, part of the Continuity System.

"You" means the person using the service. "Content" means anything you write, upload, or record in Kept Word, including answers, letters, time capsules, voice recordings, voice notes, photos, receiver details, bucket list dreams, and family recipes.

2. Eligibility

You must be at least 18 years old to create an account on Kept Word. By creating an account or subscribing to a paid plan, you represent that you are at least 18 years old. We may rely on this representation, and we reserve the right to suspend any account we have reasonable grounds to believe was created in violation of this requirement.

If you are using Kept Word on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

3. Your account

You are responsible for keeping your password safe and for everything that happens under your account. If you suspect unauthorized access, change your password immediately and contact us. You agree to give us accurate information when you register and to keep it current.

You can delete your account at any time from Settings. Account deletion uses a 30-day grace period so accidental deletion is recoverable.

4. Subscriptions and billing

Kept Word offers a free tier and paid plans. The current prices, what each plan includes, and the cap each plan applies are shown on our Pricing page.

Billing. Paid plans are billed in advance through Stripe. By upgrading you authorize us to charge your payment method for the plan you select, on a recurring basis until you cancel.

Renewal. Subscriptions automatically renew at the end of each billing period at the then-current price. You can cancel anytime from Settings or by contacting us. Cancellation takes effect at the end of the current billing period.

Plan changes. You can upgrade or downgrade at any time. Upgrades take effect immediately and may be prorated. Downgrades take effect at the start of your next billing period.

Refunds. Refund eligibility is described in our Refund Policy.

Taxes. Prices do not include taxes unless stated. You are responsible for any applicable sales, use, or value-added taxes.

5. Your content stays yours

You retain all rights in the Content you create in Kept Word. We do not claim ownership of your answers, letters, time capsules, photos, voice recordings, or anything else you put into the app.

To operate the service, you grant Human Underneath a limited, non-exclusive, royalty-free license to host, store, process, transmit, display, and create technical copies of your Content for the sole purpose of providing Kept Word to you and to the receivers you choose to share with. This license terminates when you delete the Content or your account, except where the law requires us to retain a copy (for example, for fraud or abuse investigations).

We do not use your Content to train AI models. We do not sell or rent your Content. We do not share it with advertisers.

6. AI processing

Kept Word uses AI to generate follow-up questions, moderate content, power receiver chat, transcribe audio, and synthesize speech in your voice. To do that, the relevant parts of your Content are sent to AI service providers on our behalf. They process the data to return a result and do not use it to train their public models. See our Privacy Policy for details on what is sent where.

AI output is generated by language models. It may be inaccurate, incomplete, or generic. Do not rely on it for medical, legal, financial, or therapeutic advice.

7. Voice capture

If you record audio for voice capture, you grant Human Underneath the right to send that audio to our voice synthesis provider, to receive back a voice model, and to use that model to synthesize speech in your voice when a receiver plays one of your answers. You retain ownership of your voice and your recordings.

You can delete your voice model at any time from Settings.

We will never sell or license your voice model. We will never share it with advertisers or use it for marketing.

8. Receivers and share tokens

When you add receivers and share your Space, you are giving the holders of those links the ability to read the Content you have made visible to them, without an account. You are responsible for the people you choose to share with and for revoking links you no longer want active. You can rotate or revoke share tokens at any time.

Content you mark as universal is visible to every receiver. Content you mark as specific to a single receiver is visible only on that receiver's link.

9. Legacy Keeper and Memorial Mode

You can name a Legacy Keeper. If you do, we send that person a private activation link. If your Legacy Keeper later activates the link, your account enters Memorial Mode and your Space is preserved on a free preservation tier. The activation link is single-use.

You may also provide a date of birth in Settings, and your Legacy Keeper may provide a date of passing at activation, both of which appear on the memorial banner.

We will not place an account into Memorial Mode for any other reason without an additional verification process.

10. Acceptable use

You agree not to:

  • Use Kept Word for anything illegal, or to harass, threaten, or harm another person.
  • Upload Content that infringes someone else's intellectual property, privacy, or other rights.
  • Record someone else's voice for voice capture without their consent.
  • Upload Content that contains malware, exploits, or anything designed to disrupt the service.
  • Try to reverse-engineer, decompile, scrape, or extract source code from Kept Word, except to the extent that law expressly permits.
  • Resell, sublicense, or commercially exploit the service.
  • Share or transfer your account without our written permission.
  • Impersonate another person or misrepresent your affiliation.
  • Use automated tools to access or query the service beyond reasonable personal use.

We may remove Content or restrict accounts that violate these rules.

11. The service may change

Kept Word is under active development. We may add, remove, or change features at any time. We aim to keep the service stable and to give meaningful notice before removing features you rely on, but we do not guarantee availability of any specific feature.

We do not promise the service will be uninterrupted or error-free. We perform planned and unplanned maintenance, and we depend on third-party infrastructure that may fail.

12. Suspension and termination

We may suspend or terminate your account if you violate these Terms, fail to pay for a paid plan, or if your account is involved in illegal activity. We will try to give you notice and a chance to address the issue first, except where the violation is severe or where notice would create additional harm.

You can stop using Kept Word and delete your account at any time. Your obligation to pay any unpaid fees survives termination.

13. Service is provided "as is"

Except where prohibited by law, Kept Word is provided as is and as available, without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the service will meet your requirements, that defects will be corrected, or that the service or its servers are free of viruses or other harmful components.

14. Limitation of liability

To the maximum extent permitted by law, Human Underneath, its affiliates, and its personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of Kept Word, even if we have been advised of the possibility of those damages.

In any case, our total cumulative liability arising out of or related to these Terms or the service will not exceed the greater of (a) the fees you have paid to us in the 12 months before the event giving rise to the claim, or (b) USD $50.

Some jurisdictions do not allow these limitations. Where they do not, our liability is limited to the smallest amount permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Human Underneath and its personnel from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your Content, (b) your use of the service, (c) your violation of these Terms, or (d) your violation of any third-party right.

16. Governing law and venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. The exclusive jurisdiction and venue for any dispute arising out of or related to these Terms or the service is the state and federal courts located in Cook County, Illinois, and you consent to personal jurisdiction in those courts.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will email registered users and post the update inside the app at least 14 days before it takes effect. Continued use of Kept Word after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the service before the effective date.

18. Miscellaneous

Entire agreement. These Terms, our Privacy Policy, and our Refund Policy make up the entire agreement between you and Human Underneath regarding Kept Word.

No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.

Severability. If any part of these Terms is found unenforceable, the rest stays in effect.

Assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms in connection with a sale, merger, or reorganization.

No third-party beneficiaries. These Terms do not create rights for anyone who is not a party to them.
